Welcome to Oonagh AI. These Terms of Service ("Terms") govern your access to and use of the Oonagh AI platform, including our website, applications, APIs, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
Oonagh AI ("we," "us," or "our") is a clinical documentation platform designed specifically for Licensed Acupuncturists, UK-based Medical Acupuncturists, Registered Osteopaths, Canadian Osteopathic Manual Therapists, and integrative medicine professionals.
The Service is available only to licensed or certified healthcare practitioners. By registering for the Service, you represent and warrant that you meet the professional requirements of your practicing jurisdiction.

You represent and warrant that you meet all required licenses, certifications, and insurance for your profession and will provide accurate information regarding your credentials when requested.
When registering for an account, you must provide accurate and complete information, including your name, email address, professional credentials, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
No refunds or credits will be provided for partial months of service or for periods when you did not use the Service. In cases of technical failure preventing access to core services for more than 48 consecutive hours, credits may be issued at our discretion.
Subscription fees do not include taxes. You are responsible for paying all applicable taxes associated with your subscription.
If you are a Covered Entity under HIPAA, we serve as your Business Associate. By accepting these Terms, you also accept our Business Associate Agreement, which is incorporated by reference.
We implement physical, technical, and administrative safeguards designed to protect the confidentiality, integrity, and availability of PHI as required by HIPAA.

If you provide feedback about the Service, you grant us an unlimited, irrevocable, perpetual, royalty-free license to use such feedback for any purpose without compensation to you.

THE SERVICE IS NOT INTENDED TO REPLACE YOUR PROFESSIONAL JUDGMENT OR RESPONSIBILITY FOR PATIENT CARE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE FORM OF ACTION, IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
These Terms are governed by the laws of the United Kingdom, without regard to its conflict of law principles.
Any dispute arising from these Terms will be resolved through arbitration in London, United Kingdom, under the rules of the London Court of International Arbitration.
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, and Internet service interruptions.
